1. Introduction and data collection

The simple navigation through the website of Ecoportatil does not require the user to provide personal data. Only if the user fills out forms, makes a purchase, contacts us, or uses any of the available services will the data they have provided be processed.

Always that Ecoportatil shall process personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR), Organic Law 3/2018 of 5 December (LOPDGDD), and the rest of the applicable Spanish legislation on information society services.

3. Purposes and legal bases of the processing

The main situations in which are detailed below Ecoportatil can process your data, the purpose of each one, and the legal basis that allows it.

3.1. User registration (“New customer”)

Purpose: register the user on the Ecoportatil website so they can manage their data, shipping addresses, order history, or inquiries.

Legal basis: consent of the data subject (art. 6.1.a RGPD).

Conservation: until the user requests the deletion of their account or stops using it for an extended period according to Ecoportatil's internal policies.

3.2. Order processing and handling

Purpose: manage the purchase made on the website, prepare the order, ship it, handle returns, shipping incidents, warranties or after-sales service.

Legal basis: execution of a sales contract or pre-contractual measures (art. 6.1.b RGPD).

Necessary communications: when the product has a manufacturer’s warranty or requires technical intervention, the strictly necessary data may be communicated to the technical service or manufacturer in order to process the warranty. This communication is covered by compliance with consumer and user regulations (Royal Legislative Decree 1/2007) and by art. 6.1.c GDPR.

Conservation: while the customer account exists. After that, the data will remain blocked for the statutory limitation periods (tax, accounting, warranties).

3.2.1. Delivery and recipient verification

To deliver the order safely, the transport company may request some identifying information (full name, ID visible) solely to verify that the delivery is made to the correct person and to prevent fraud.

These data will not be photographed or stored by the courier.

If the pickup is carried out by a third party other than the buyer, the processing is based on the legitimate interest of Ecoportatil de prevent fraud (considering 47 GDPR).

Conservation: only for the period necessary to verify correct delivery and, afterward, blocked until any possible legal actions are time-barred.

3.2.2. Notices about the order

The contact details (email address and, where applicable, phone or WhatsApp) may be used to inform you about the status of the order, shipping issues, or delivery.

Legal basis: execution of the contract (art. 6.1.b RGPD).

These communications are informative and not promotional.

3.3. Commercial communications and newsletters

Ecoportatil

can send commercial information about refurbished products, offers, special campaigns or services related to the company's activity.

a) When the user has not purchased yet
Purpose: commercial information will only be sent if the user has given express consent through a form or acceptance checkbox.
Legal basis: consent (art. 6.1.a RGPD).
Conservation: until the user withdraws consent.

b) When the user is already an Ecoportatil customer
In that case, Ecoportatil may send advertising about products or services similar to those purchased, based on art. 21.2 of Law 34/2002 (LSSI). The user may object at any time from the email received itself or by writing to informacion@ecoportatil.es.

c) Shipping tool
Ecoportatil may use an external email delivery platform (for example, Brevo/Sendinblue) solely to manage the sending of newsletters. The provider will process the data on behalf of Ecoportatil and under a data processing agreement.

3.4. Participation in giveaways or promotions

Purpose: gestionar participation, select winner/s and contact the awarded person.

Legal basis: execution of the relationship derived from participation (art. 6.1.b RGPD).

Conservation: during the time necessary for the drawing and the legal obligations arising from it.

3.5. Contact forms

Purpose: to handle the inquiry, incident, quote request, or information sent by the interested person.

Legal basis: consent (art. 6.1.a RGPD) or the application of pre-contractual measures (art. 6.1.b RGPD) when the inquiry is related to a possible purchase.

Conservation: during the time necessary to resolve the request.

3.6. Visits or in-person support (if applicable)

Purpose: organize the visit or assistance at the facilities or warehouse when the user requests it.

Legal basis: consent (art. 6.1.a RGPD).

Conservation: during the time of management of the visit and, at most, two years after it is carried out.

3.7. Publication of opinions or reviews

Ecoportatil can allow customers to post reviews about products or about the service. It is not necessary to use the real name; an alias can be used.

Purpose: show the customer's opinion publicly.

Legal basis: consent (art. 6.1.a RGPD).

Conservation: while the review is published or until the user requests its removal. If the review violates moderation rules, Ecoportatil may retain the data for the duration of the investigation or the statute of limitations for any possible actions.

3.8. Services for third parties / logistics (“Fulfillment”)

If Ecoportatil offers logistics or preparation/shipping services to third-party sellers; in those cases, it will act in accordance with the instructions of the true controller (the seller) and will only process the data to provide that service.

Conservation: during the period necessary to guarantee the product and handle any claims.

3.9. Solicitudes for repair or SAT

Purpose: process repair requests, quotes, or warranty claims.

Legal basis: consent (art. 6.1.a RGPD) and, in the event of acceptance of the quote or intervention, performance of the contract (art. 6.1.b RGPD).

Conservation: during the time necessary for the provision of the service and, afterwards, blocked for the limitation periods.

3.10. Chat or instant support (including business WhatsApp)

Purpose: respond to questions about products, orders, or support.

Legal basis: pre-contractual measures or contract performance (art. 6.1.b RGPD).

Conservation: the minimum time required to respond.

3.11. Forms or specific procedures (Kit Digital or other calls)

Purpose: to handle the information request and, where applicable, process the service with the administration or with third-party partners.

Legal basis: consent (art. 6.1.a RGPD) and performance of contract/service (art. 6.1.b RGPD).

Communications: you will be informed when the data must be sent to a public administration or partner.

Conservation: during the processing time of the procedure and subsequent blocking during the legal deadlines.

3.12. Communication of product security incidents

If an authority or a customer communicates to Ecoportatil a possible product safety issue, the data will be processed to analyze and investigate the case.

Legal basis: compliance with legal obligations in the field of product safety (art. 6.1.c RGPD and applicable European regulations).

Conservation: during the investigation period and until the statute of limitations for actions.

3.13. Fraud prevention

Ecoportatil may process data to detect anomalous transactions, identity theft, fraudulent use of payment methods, or improper returns.

Legal basis: legitimate interest of Ecoportatil in protecting its business and its customers (Recital 47 GDPR).

Conservation: during the investigation period and subsequently blocked until the statute of limitations for actions expires.

The data will only be disclosed to third parties if there is a legal obligation to do so (Law Enforcement, courts).

4. Data recipients

As a general rule, Ecoportatil no will share the data with third parties unless:

• There is a legal obligation.
• It is necessary for the provision of the requested service.
• The user has expressly authorized it.

In particular, the data may be communicated to:

• Banking entities or payment gateways for order collection.
• Transport and logistics companies for product shipping.
• Technical services, manufacturers or wholesalers when it is necessary to process a warranty.
• Public administrations and consumer agencies in case of claims.
• Forces and Security Corps, when requested.
• Communication delivery platforms (e.g. Brevo/Sendinblue) for sending commercial or transactional emails, acting as data processors.

In the event that any supplier is located outside the European Economic Area, Ecoportatil verifies that an adequate legal basis exists for the transfer (adequacy decision, standard contractual clauses or applicable framework).

5. Rights of data subjects

Any person who has provided data to Ecoportatil can exercise the following rights:

• Access: know what data we process.
• Rectification: correct inaccurate or incomplete data.
• Suppression: request the deletion of their data when it is no longer necessary.
• Limitation of processing.
• Portability: receive the data in a structured format.
• Opposition: for example, to receive advertising.

To exercise them, the interested person can write to: informacion@ecoportatil.es indicating in the subject line “Data Protection”, attaching a copy of your ID card or equivalent document.

If there were reasonable doubts about the identity, Ecoportatil may request additional information.

Likewise, the data subject may lodge a complaint with the Spanish Data Protection Agency if you consider that your request has not been handled correctly. However, Ecoportatil recommends contacting first with informacion@ecoportatil.es to try to resolve it amicably.

6. Data Protection Officer

Ecoportatil has enabled email informacion@ecoportatil.es for any matter related to privacy, exercising rights, or information security.

7. Data quality

The user guarantees that the data provided is true, accurate, and up to date. Ecoportatil is not responsible for any damages or losses that may arise from failure to comply with this obligation.

8. Minors' data

Ecoportatil does not knowingly collect data from children under 14 years of age. If it is detected that such data has been collected, it will be securely deleted. It is the responsibility of parents or legal guardians to supervise minors’ use of the Internet.

9. Social media

Ecoportatil may have profiles on social networks (Facebook, Instagram, YouTube, TikTok or others). The processing of data carried out on those platforms will be governed by each platform’s privacy policies. Social networks are not affiliated with Ecoportatil, and the information published there is visible to other users of the network.

10. Legal information and terms of use of the site

In compliance with Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce, it is hereby informed that the website ecoportatil.es is exploited by PortatilEco Spain S.L., with address at C/ San Millán nº 27, 29013 Málaga, Spain, and CIF B05484332.

The access to the website grants the status of user and implies acceptance of these terms of use. The user undertakes not to use the website for illegal activities or activities contrary to good faith, and not to cause damage to the systems of Ecoportatil o of third parties, not to introduce viruses and not to try to access other users' accounts.

All website content (texts, images, logos, brands, designs, code) belongs to Ecoportatil or third parties who have authorized its use and are protected by intellectual and industrial property regulations. Its reproduction, distribution, or transformation without express authorization is prohibited.

Ecoportatil reserves the right to modify the contents, design, or access conditions of the website without prior notice.

11. Cookies Policy (summary)

The website of Ecoportatil uses technical, personalization and analytics cookies. Some are necessary for the website to function and others require the user's consent. The user can configure their browser to accept them, reject them or delete those already installed. If some cookies are disabled, certain services may not work correctly.

11.1. Technical storage of Ealyx

The Ecoportatil website may use browser local storage (localStorage) for the correct functioning of certain services, such as the one offered by Ealyx.

Type:
Local storage (localStorage). It is not a cookie, although it may appear in consent management tools within the technical storage category.

Domain:
Associated with the website's own domain.

Duration:
This storage does not have an automatic expiration defined by the browser. However, the data is automatically deleted after 24 hours.

Purpose:
Allow the operation of the Ealyx service, storing the rating generated for the user and the information necessary to manage that rating.

Legal basis:
Legitimate interest and/or provision of the service requested by the user (art. 6.1.b y 6.1.f RGPD), as it is a necessary element for the operation of the functionality voluntarily activated.

Personal data processing:
It may include certain personal data solely for the purpose of detecting whether the user has logged out.

Data sharing with third parties:
No data is shared with third parties.

Classification:
First part (first-party) and necessary or essential storage, since it is essential for the operation of the service and is not activated without user interaction.

12. International transfers related to cookies and external services

Certain analytics, advertising or technical support tools used by Ecoportatil may involve transfers of data outside the European Economic Area. In such cases, Ecoportatil will ensure that the providers are subject to European Commission adequacy decisions or have signed the standard contractual clauses.

13. Policy update

Ecoportatil may modify this privacy information and terms of use whenever it deems necessary due to regulatory changes or changes in its data processing activities. The current version will always be the one published on the website with the last updated date.
