2. Purpose and scope

This document governs access to, browsing of and use of the Ecoportatil website, as well as the processing of personal data and the use of cookies and similar technologies.

Accessing the website confers the status of user and implies acceptance of the terms set out in this document. Users who do not agree with these terms must refrain from using the website.

The terms applicable to the purchase of products, shipping, payment, the right of withdrawal, returns and guarantees are set out in the Ecoportatil Terms and Conditions of Sale.

3. Terms of use

Users undertake to use the website, its content and its services lawfully, responsibly and in good faith.

The following are prohibited:

Ecoportatil will process personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016, the General Data Protection Regulation (GDPR), Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), Spanish Law 34/2002 (LSSI) and any other applicable legislation.

7.2. Personal data processed

Depending on the relationship with Ecoportatil, the following categories of data may be processed:

• Identification data: first name, surname(s), Spanish identity or tax number (DNI, NIE or NIF) or an equivalent document where necessary.

• Contact data: postal address, telephone number and email address.

• Billing and delivery data.

• Data on orders, products purchased, returns and guarantees.

• User account data.

• Communications by email, telephone, forms, chat or WhatsApp.

• Information provided in connection with issues, repairs or support requests.

• Photographs, videos, documents and serial numbers provided in the course of an issue.

• Data required to process payments; Ecoportatil does not store full bank card details where payment is handled through an external payment gateway.

• Technical and browsing data, such as IP address, device type, browser, technical identifiers and access logs.

• Data required to prevent and analyse fraudulent transactions.

• Information provided when taking part in promotions, prize draws or reviews.

Simply browsing the website does not require users to provide identification data, without prejudice to the technical information processed by means of cookies, security logs and similar technologies.

7.3. Registration and user account

Purpose: to create and maintain the customer account, provide access to the personal area and manage addresses, orders, invoices, enquiries and issues.

Legal basis: performance of the contractual relationship or taking steps at the request of the data subject prior to entering into a contract (Art. 6(1)(b) GDPR).

Retention: for as long as the account remains active. Where closure of the account is requested, the necessary data will be blocked for the applicable statutory periods.

7.4. Placing and processing orders

Purpose: to manage the purchase, payment, invoicing, preparation, shipping, delivery, returns, withdrawal, guarantees and after-sales service.

Legal basis: performance of the contract of sale (Art. 6(1)(b) GDPR) and compliance with legal obligations relating to tax, accounting and consumer protection (Art. 6(1)(c) GDPR).

Retention: for the duration of the contractual relationship and thereafter, in blocked form, for the statutory periods applicable to tax, accounting, contractual, guarantee and liability matters.

7.5. Delivery and verification of the recipient

Carriers may process the identification and contact data necessary to make the delivery.

Where necessary to prevent errors or fraud, the carrier may ask to see an identity document in order to check that the delivery is being made to the authorised person. The document may only be retained or copied where this is necessary and legally justified, and the data subject has been informed in advance.

Where the order is collected by a person other than the purchaser, the data necessary to verify that person's authorisation may be processed.

Legal basis: performance of the contract and the legitimate interest of Ecoportatil and the customer in ensuring secure delivery (Arts. 6(1)(b) and 6(1)(f) GDPR).

7.6. Order notifications

Ecoportatil may use email, telephone or WhatsApp to provide information about the confirmation, preparation, dispatch or delivery of an order, or about any issues relating to it.

These communications are necessary for the performance of the contract and are not promotional in nature.

7.7. Contact forms and enquiries

Purpose: to deal with enquiries, requests for information or quotations, questions about products or any other communication sent by the data subject.

Legal basis: consent, in the case of a general enquiry, or taking pre-contractual steps where the enquiry relates to a potential purchase (Arts. 6(1)(a) and 6(1)(b) GDPR).

Retention: for as long as necessary to deal with the enquiry and thereafter for the periods required to address any potential liability.

7.8. Issues, guarantees, returns and support via Odoo

Requests relating to guarantees, repairs, returns, withdrawal or after-sales assistance may be handled through the Ecoportatil support portal, available at:

This portal uses the Odoo platform to identify the customer, link the request to their order, manage the issue, exchange messages and documents, track the case and communicate its outcome.

The data processed may include:

• Identification and contact data.

• Order and product information.

• The device's serial number.

• A description of the issue.

• Photographs, videos and documents provided.

• Collection and delivery addresses.

• Communications exchanged while the case is being handled.

• Information on repairs, replacements, returns or refunds.

Legal basis: performance of the contract and compliance with legal obligations relating to guarantees, withdrawal and consumer rights (Arts. 6(1)(b) and 6(1)(c) GDPR).

Retention: for as long as necessary to handle the issue and thereafter, in blocked form, for the statutory periods applicable to guarantees, liability and potential claims.

7.9. Repairs and technical service

Where a product requires inspection, repair or technical intervention, the strictly necessary data may be disclosed to technical service providers, manufacturers, suppliers or carriers.

Legal basis: performance of the contract and compliance with legal obligations relating to guarantees (Arts. 6(1)(b) and 6(1)(c) GDPR).

7.10. Marketing communications and newsletters

Ecoportatil may send information about refurbished products, offers, campaigns and services related to its business.

Persons who are not yet customers

Marketing communications will only be sent where the person has given their consent by means of a tick box or form.

Legal basis: consent (Art. 6(1)(a) GDPR).

Ecoportatil customers

Ecoportatil may send marketing information about products or services similar to those previously purchased, in accordance with Article 21(2) of the LSSI.

Data subjects may object at any time by using the unsubscribe link included in each communication or by writing to informacion@ecoportatil.es.

Specialised platforms, such as Brevo, may be used to manage these mailings, acting as data processors.

Retention: until consent is withdrawn or the right to object is exercised, without prejudice to the retention of the minimum information necessary to evidence the unsubscription.

7.11. Chat and WhatsApp

Purpose: to answer enquiries about products, orders, issues or support.

Legal basis: consent, pre-contractual steps or performance of the contract, depending on the content of the enquiry (Arts. 6(1)(a) and 6(1)(b) GDPR).

Where WhatsApp is used, the processing will also be subject to its provider's terms and privacy policies.

7.12. Ratings and reviews

Purpose: to manage and publish ratings of products or of the service provided.

Legal basis: consent of the data subject (Art. 6(1)(a) GDPR).

Users may post under an alias and request the removal of their review. Where a post may constitute abuse, fraud or unlawful content, the necessary data may be retained for the duration of the investigation and the applicable limitation periods.

7.13. Prize draws and promotions

Purpose: to manage participation, verify compliance with the terms and conditions, select and contact the winners and comply with the associated legal obligations.

Legal basis: performance of the relationship arising from participation and compliance with the terms and conditions of the promotion (Art. 6(1)(b) GDPR).

Retention: for the duration of the promotion and thereafter for the applicable tax or statutory periods.

7.14. Logistics services for third parties

Where Ecoportatil provides order storage, preparation or shipping services on behalf of other sellers, it may act as a data processor, following the instructions of the seller acting as data controller.

The data will be used solely to provide the logistics service and to deal with any related issues.

7.15. Fraud prevention and security

Ecoportatil may process identification data, order information, payment methods, IP addresses, delivery addresses, devices and behavioural patterns in order to detect anomalous transactions, identity theft, fraudulent payments or abuse relating to orders and returns.

Legal basis: the legitimate interest of Ecoportatil, its customers and payment providers in preventing fraud and protecting the security of transactions (Art. 6(1)(f) GDPR).

Data may be disclosed to banks, payment platforms, insurance companies, law enforcement agencies, courts or competent authorities where there is a legal basis permitting such disclosure.

The application of anti-fraud measures will not necessarily involve decisions based solely on automated processing that produce legal effects for the data subject. Where a transaction requires additional checks, it may be reviewed by authorised staff.

7.16. Product safety

Where an authority, manufacturer or customer reports a possible safety problem with a product, Ecoportatil may process the data necessary to investigate the case, contact the persons affected and comply with its legal obligations.

7.17. Recipients of the data

The data may be disclosed or made available to:

• Banks and payment gateways.

• Transport, logistics and collection companies.

• Technical service providers, manufacturers, distributors or wholesalers.

• Hosting, maintenance, cybersecurity and IT service providers.

• Providers of business management and support platforms, including the Odoo platform.

• E-commerce and online shop management providers, including the PrestaShop platform.

• Email and communications platforms, such as Brevo.

• Chat or messaging support providers.

• Consent and cookie management platforms.

• Tax, accounting and legal advisers, and insurers.

• Public authorities, consumer protection bodies and tax authorities.

• Law enforcement agencies, courts and tribunals where required by law.

These providers will process only the data necessary to provide their services and, where applicable, will act as data processors subject to the instructions of Ecoportatil.

7.18. International transfers

Some technology, communications, analytics, advertising, payment or support providers may be located outside the European Economic Area or may process data from third countries.

Where an international transfer takes place, Ecoportatil will ensure that one of the mechanisms permitted under the GDPR applies, such as:

• An adequacy decision of the European Commission.

• The EU-US Data Privacy Framework, where the provider participates in it.

• Standard contractual clauses approved by the European Commission.

• Any other valid mechanism under Articles 44 et seq. of the GDPR.

This contact address does not imply that Ecoportatil has formally appointed a data protection officer, unless such an appointment is expressly communicated.

7.21. Data relating to minors

Ecoportatil does not specifically target its services at children under the age of 14 and does not knowingly collect their data without the appropriate authorisation.

Where it is found that a minor's data have been collected without a sufficient legal basis, the necessary measures will be taken to delete them.

7.22. Social media

Ecoportatil may have profiles on Facebook, Instagram, YouTube, TikTok and other social networks.

Any processing carried out directly by each platform will be subject to its own terms and privacy policies. Information published by users in public areas may be visible to other users.

7.23. Security and confidentiality

Ecoportatil will take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration, disclosure or destruction.

Staff and providers who have access to personal data will be bound by confidentiality obligations.
